Do The Right Thing: fiduciary duty, divestment and the law.
David Hunter, Bates Wells & Braithwaite London LLP
In both the US and the UK, there is growing debate around whether mission-aligned investment, and in particular divestment from fossil fuels, is a discretionary choice or a legal requirement. This session brings together those responsible for endowments and those advising on the legal position on both sides of the Atlantic, for a lively conversation, involving the audience, around how trustees ought to be behaving, what inhibits them and how these inhibitors are being overcome on each side of the pond. It remains a nuanced debate, but notwithstanding that, increasing numbers are resolving to Do The Right Thing.
